Studio Bookings - Terms & Conditions
The following are the conditions of use of the co-shared studio services at Mitchell Vincent Collection Ltd that forms part of the agreement between every client and Mitchell Vincent Collection Ltd.
Hiring charges
The Mitchell Vincent Collection Ltd Studio space is charged depending on the time, date and equipment the client specifies using the Studio Package Form. Charges commence from the beginning period of the booking to the date upon which the customer has left the property. The client also agrees to pay any equipment costs, cleaning | damage charges if needed and GST.
Studio | Workplace Supervision
Studio Package booking provides a studio | workroom supervisor who look after all co-shared spaces in the Mitchell Vincent Collection Ltd space. Our Studio and Showroom supervisors hours are included into costs invoiced. At no times are we not including supervision as the property includes co-shared spaces including stock, equipment and security systems.
Damage Cost
Mitchell Vincent Collection Ltd charges a 10% ‘damage cost’ if the client losses or damages the interior or equipment involved, except for fair wear and tear that is not negligent.
The client must ensure that photography equipment hired from us is stored in a secure place at all times. Equipment left unattended or in a car in a public place is not covered by our insurance and we would consider the client to be negligent. In the case of negligence, the whole or part of the costs of replacement or repair to the equipment may be charged to the client.
Your property when in the studios
Mitchell Vincent Collection Ltd will not be held responsible for the loss, theft, or damage of any property of any person is using in the studios.
All care will be exercised by Mitchell Vincent Collection Ltd in supervising the studio, however all clients are required to make appropriate arrangements to ensure their property is properly secure whilst in the facilities. Clients leaving property in the studios, at reception or in the equipment room overnight do so at their own risk. Clients are advised to ensure that their insurance policy covers them whilst using the facilities at Mitchell Vincent Collection Ltd.
Third party rental items
Mitchell Vincent Collection Ltd cannot permit insurance for equipment from third parties if damaged or stolen from the premises as this voids our insurance policy.
Age Restrictions
When making a booking with Mitchell Vincent Collection Ltd, you are confirming you are over the age of 18 years.
All guests | models and clients on site must be over the age of 16 years of age. We do not allow children on the premise. The Mitchell Vincent Collection Ltd space is a co-shared studio that is located by Mitchell Vincent Collection Showroom and Workroom. For health and safety and also peace of mind, we must only have people the age of 16+ on the property as there are equipment, industrial machinery, materials, specialized equipment and stock in reach. We are a space for working professionals. There are no exceptions.
Cleaning | Care of Studio
Mitchell Vincent Collection Ltd has included costs in hire fee for basic cleaning. If the space is lift in a condition which is beyond our cleaning equipment we have on hand then cost of cleaning will be charged to the client. All items that are hired from the client is lift in good condition. Equipment should not require cleaning. It is agreed that the whole or any part of the costs incurred in cleaning damages to the Mitchell Vincent Collection Ltd property may be charged to the client.
Sub-hire
The parties agree that the client is agreeing to booking of the Studio for their own business, has agreed that this is for their own use and shall not part with the possession of the equipment or otherwise sub-lease, sub-hire, or assign the benefit of the agreement to any other person or corporation without prior written consent of Mitchell Vincent Collection Ltd.
Breakdowns | Malfunction
In the event of a breakdown or failure of equipment the client shall immediately notify Mitchell Vincent Collection Ltd. If Mitchell Vincent Collection Ltd is not informed immediately upon breakdown or malfunction, the client will be responsible for and and all damage and or repair costs. On no account should the client repair or attempt to repair the equipment without prior consent of Mitchell Vincent Collection Ltd. In the event that such a breakdown or failure is caused by reasonable wear and tear and not by the client’s negligence or misuse. Mitchell Vincent Collection Ltd will use its own discretion when deciding whether or not the space or equipment has been negligent. In the case of negligence the whole or part of the costs of replacement may be charged the client: Mitchell Vincent Collection Ltd will not be liable for any damage claims, cross hire fees, or any other fees due to breakdown, malfunction or misuse of equipment.
Termination of Agreement
If any of these booking terms are breached, Mitchell Vincent Collection Ltd reserves the right to cancel the booking immediately. Mitchell Vincent Collection Ltd reserves the right to change these terms at any time without notice.
Payment terms
Deposit: Credit terms is payment of 50% deposit 14 days before date booked to keep date required, remaining 50% should be paid 24 hours before the date of booking. If payment if not received by Mitchell Vincent Collection Ltd within the times agreed above, the agreement date becomes invalid.
Once an invoice is received, any queries or disputes regarding charges appearing on the invoice must be directed to Mitchell Vincent Collection Ltd within 7 days.
Charges
All price and booking charges shall be as quoted by Mitchell Vincent Collection Ltd. All prices include time charge plus GST. All quotations shall remain valid for a period of 30 days from the date on which they are first given, unless the Client’s dates differs from the requirements or specifications on which such quotation was based. The provision of a quotation by Mitchell Vincent Collection Ltd to the Client does not guarantee the availability of the studio facilities, consumables and/or services specified in such quotation, either at the time of the quotation or at the time the Client wishes to place its date. Prices, booking charges and/or quotations provided by Mitchell Vincent Collection Ltd may be subject to change without warning.
Where hire charges include a charge for the provision of personnel, overtime rates may apply during certain hours or after certain periods of time, in accordance with Mitchell Vincent Collection Ltd applicable price lists(s). Overtime charges including expenses for Mitchell Vincent Collection Ltd personnel will be charged to the Client, in addition to applicable hourly rates and hire charges.
Cancellation
If any booking is cancelled by the client less than 48 hours prior to the intended start of the booking period, the 50% deposit that has been paid by the client will be claimed and not refunded due to lack of communication and breach of studio hire agreement.
If there is a change of date request from the client with over 48 hours notice, the client can request a change of date from Mitchell Vincent Collection Ltd to a new date that works for both parties. If a date is not approved by both parties, a refund can be applied if there is 48 hours before original booking date.
If the client cancels their booking on the date agreed | intended start of the booking period, the Client shall pay Mitchell Vincent Collection Ltd 100% of the hire charges for studio booking for the booking period. This is considered a breach of agreement.
General
Mitchell Vincent Collection Ltd reserves the right to change operating hours. The Client may not assign, sub-license or sub-contract any of its rights or obligations under the Terms of booking without prior written consent of Mitchell Vincent Collection Ltd. These Terms of booking constitute the entire agreement and understanding between the parties with respect to their subject matter and supersede any prior agreement, understanding or arrangement between the parties, whether oral or in writing, with respect to the same. No representation, undertaking or promise shall be taken to have been given or be implied from anything said or written in communications between the parties except as set out in these Terms and Conditions. Neither party shall have any remedy in respect of any untrue statement made to it upon which it has relied (unless such untrue statement was made fraudulently) and that party’s only remedies shall be for breach of contract as provided in these Terms of Business.
By accepting the Studio Booking form, the client agrees without limitation to all of Mitchell Vincent Collection Ltd Terms and Conditions stated above.
